5.Time Limits on Injury Claims

South Carolina law places strict deadlines on injury claims. In most personal injury cases, the statute of limitations is three years from the date of the accident under S.C. Code Ann. § 15-3-530. If you miss the deadline, your claim is barred permanently, no matter how strong it was.

Not every case gets three years. Claims against a governmental entity under the South Carolina Tort Claims Act have shorter deadlines and notice requirements. Other exceptions and shorter periods can apply depending on who is at fault and the nature of the claim.
